Spousal Maintenance

Family & Defacto Law services

After a Divorce or Separation

Depending on your circumstances, you may be entitled to spousal maintenance, whereby one person provides ongoing periodic or lump sum financial support for their former partner. Spousal support is different to child support, which is provided for the children’s expenses.

Armstrong Kutz Lawyers can advise if you are entitled to claim spousal maintenance, or whether you are obliged to pay spousal maintenance if a claim is made against you. We will consider the income and earning capacity of both parties, and advise whether there are grounds for a spousal maintenance claim.

The entitlements and obligations surrounding spousal maintenance apply not only to former married couples, but also to those in de facto and same-sex relationships.
